Study shows about 800,000 unnecessary foreclosures

Do you need help with foreclosure and think that you might have been the victim of mortgage fraud or predatory lending practices?

A recent study showed that about 800,000 homeowners in the U.S. have been pushed into foreclosure unnecessarily.

The study was conducted by: the Federal Reserve Bank of Chicago, the government’s Office of the Comptroller of the Currency (OCC), Ohio State University, Columbia Business School, and the University of Chicago, as reported by ProPublica.

It was meant to evaluate the effectiveness of the HAMP program which proved the program not as successful as they hadhoped, actually, not nearly as successful.

“Even in the sixth year of the foreclosure crisis, the country remains saddled with an extraordinarily high number of loans in foreclosure — about 2 million, as reported in a ProPublica article. “That backlog hasn’t improved much in the last couple years, meaning it’s still hard to forecast when the foreclosure rate will return to a normal level.”

If you need help with foreclosure, there is still hope. Call The Foreclosure Law Center, P.C. today at 1-888-600-5505 for a free consultation. -24 hours-

MetLife Fined by Fed for Abusive Foreclosure Practices

“Steven Kandarian, the chief executive officer of New York- based MetLife Inc., has struck a deal to sell deposits to General Electric Co. as part of a plan to depart banking,” Bloomberg Businessweek.

Recently MetLife was served a $3.2 million penalty by the Federal Reserve for abusive foreclosure handlings.

Earlier this year a $25 billion settlement was reached with the five largest lenders in the country, MetLife not included.

MetLife will now no longer be able to leave the banking industry quietly.

“The Board is taking action against MetLife at this time in light of MetLife’s publicly announced decision to sell its subsidiary bank’s deposit-taking operations,” the Fed said in an e-mailed statement August 7, 2012, Bloomberg. “The Board continues to believe that monetary sanctions in the remaining cases are appropriate and plans to announce monetary penalties against those organizations.”

In July 2012, one in every 2,036 housing units received a foreclosure filing in New York. The need for foreclosure help in New York has continued to rise along with the rest of the country in need of help with foreclosure.

“I know that investors are eager for a resolution of this issue but the timing is outside of MetLife’s control,” Kandarian said in an Aug. 2 conference call, Bloomberg.

Five reasons why attorney-driven foreclosure help is a homeowner’s best bet…

The Foreclosure Law Center has been helping homeowners across the country to stay in their homes and have affordable monthly mortgage payments.

Many homeowners try to negotiate loan modifications with their lenders on their own, but having legal representation may dramatically increase your chances of securing foreclosure help, and here’s why:

  1. Lenders tend to be much more responsive and cooperative when a borrower has legal representation.
  2. Attorneys operating in this space have a deep understanding of the legal intricacies, technicalities and seemingly infinite regulations related to loan modifications, as well as the homeowner’s legal rights related thereto.
  3. Attorneys have the specialized skill, expertise and experience required to aggressively negotiate the best possible foreclosure help terms for the client.
  4. Attorney-written loan modification requests often receive higher priority routing, leading to expedited responses and at a higher level, often directly with the bank’s legal department or a senior-level asset manager, thus circumventing lower level, slower moving junior loan modification personnel who typically conduct the initial reviews.
  5. Loan modification attorneys have an in-depth understanding of consumer protection laws such as the Truth in Lending Act (TILA) and the Real Estate Settlement Procedures Act (RESPA). An attorney can also best determine if a broker or lender violated any state or federal law when originating a home mortgage, or if there was any activity that can be deemed loan fraud or predatory lending practice, with the Forensic Loan Audit. If so, an attorney can best capitalize on the indiscretion – and the threat of costly litigation related thereto – to negotiate a desirable outcome for the homeowner.

Bank of America Offers a Chance for Principal Reductions to 200,000 Homeowners

Bank of America is offering a one-time chance for 200,000 homeowners to reduce their principal balances. Officials said they are going to begin mailing letters stating this opportunity to select homeowners, according to CNBC.

“If people get these things and toss them, they won’t be eligible,” says Ron Sturzenegger, the Bank of America executive charged with providing solutions to borrowers in need of mortgage assistance, in the CNBC article.

Although this offer may sound “too good to be true,” Bank of America has confirmed it is real and qualified homeowners who possibly need help with foreclosure will have the chance to knock off as much as $150,000 from the principal of their mortgages.

“Bank of America, in a deal with state attorneys general and the U.S. Department of Justice, committed $11 billion to mortgage principal reduction, but executives say they will go beyond that if enough borrowers respond to their offer,” as stated in the CNBC article.

This offer has the potential to help many struggling homeowners in need of foreclosure help. The reality of the situation is that this offer will barely reach a fraction of families who really need to restructure their mortgages.

For those who do not qualify for this offer, the Mortgage Forensic Audit can uncover over 335 civil law violations that may be violated in your loan documents. A foreclosure attorney can use this information to help you avoid foreclosure and stay in your home.

New York and Pittsburgh lead with biggest quarterly increases in foreclosure activity

RealtyTrac released its Quarterly, 2012 Metropolitan Foreclosure Market Report, which showed 114 out of the 212 major metro areas in the country have increased in foreclosure activity.

Help with foreclosure in Pittsburgh, PA is evident with a 49 percent rise in foreclosure activity over the past quarter.

The same goes for foreclosure help in New York with a 24 percent rise in mortgage default and foreclosure activity.

“First quarter metro foreclosure trends were a mixed bag,” said Brandon Moore, chief executive officer of RealtyTrac, as reported by RealtyTrac staff. “While the majority of metro areas continued to show foreclosure activity down from a year ago, more than half reported increasing foreclosure activity from the previous quarter — an early sign that long-dormant foreclosures are coming out of hibernation in many local markets.”

The Mortgage Forensic Audit reviews over 335 civil law violations that could be in your own loan documents. Foreclosure lawyers can help save your home.

Hidden foreclosure crisis costs

Since 2007, the foreclosure crisis has been increasingly rampant across the United States.

In a recent Yahoo! Finance, MarketWatch report, Amy Hoak discussed the upcoming trends and less talked about affects of the foreclosure crisis. Help with foreclosure is not solely needed for saving your home but also for many deeper issues.

“Five million foreclosures have occurred since 2007, according to the Center for Responsible Lending, a nonprofit that works to protect homeownership by fighting predatory lending practices. And the crisis is only halfway over: There are 3 million to 5 million more foreclosures expected in the next couple of years, according to the center’s best estimate,” Hoak said.

Unfortunately, in many cases, for each of the millions of families affected by the crisis, about one in 10 kids is affected, according to a recent report by First Focus.

Children are deeply affected by foreclosure in every aspect of living, from eating properly, having stable housing and other basic needs that are unlikely to be effectively fulfilled in a foreclosure help situation.

Health issues are a major concern for the entire population.

“A recent study found a correlation between the increase in foreclosures and the increase in medical visits for mental health, preventable conditions and stress-related complaints, Hoak reported. Mental health visits might include anxiety or suicide attempts and preventable conditions might include hypertension.”

Finally, as a whole, communities are facing security issues due to the loss of property tax revenue, affecting every community aspect from senior centers to swimming pools, Hoak said.

Vacant properties are debilitating neighborhoods and with talks of the crisis, only being about half-way through, foreclosure help will continue to be needed throughout the country.
